This Privacy Policy explains how EZ Capital Group Inc. (“EZ Capital,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with our websites, application portals, communications, and related services, including our commercial-financing marketplace and referral programs (collectively, the “Services”). EZ Capital is a financial technology company and marketplace that helps businesses connect with funding sources; EZ Capital is not a bank and does not itself make funding or credit decisions.
By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services. Capitalized terms not defined here have the meaning given in our Terms and Conditions.
1. Scope
This Privacy Policy applies to business applicants and their owners and representatives, website visitors, referral partners, and others who interact with the Services. Separate or supplemental notices may apply to specific programs and control to the extent of any conflict for that program.
2. Information We Collect
We collect the following categories of information:
• Identifiers and contact information — name, business name, postal and email address, and phone number.
• Business and application information — information about your business, ownership, financing needs, and the information and documents submitted with a funding request.
• Financial information — bank statements, revenue, transaction history, and other financial information you provide.
• Credit and consumer-report information — credit reports, scores, and related information obtained from consumer reporting agencies with your authorization, as described in our Terms and Conditions.
• Identity-verification information — government identifiers and verification data collected to comply with law (for example, the USA PATRIOT Act).
• Usage and device information — IP address, browser and device type, identifiers, pages viewed, and diagnostic data collected automatically.
• Location information — approximate location derived from IP address or, with permission, from your device.
• Communications — records of your communications with us.
We collect this information directly from you and your business, automatically through your use of the Services, from referral partners who introduce you, and from third parties such as consumer reporting agencies, identity-verification providers, and analytics and advertising partners.
3. How We Use Information
We use information to:
• provide, operate, and improve the Services, including to match your funding request with funding sources and facilitate applications;
• evaluate and process funding requests and obtain consumer reports for that permissible purpose, with your authorization;
• communicate with you about the Services, your requests, and administrative matters;
• send marketing and promotional communications consistent with your choices and applicable law;
• analyze usage, conduct research, and develop new products and features;
• detect, prevent, and investigate fraud, security incidents, and misuse; and
• comply with legal, regulatory, tax, and contractual obligations and establish, exercise, or defend legal claims.
4. How We Disclose Information
We disclose information as follows:
• Funders and funding sources — to the funding sources and their respective affiliates, service providers, and prospective participants or purchasers (“Funder Parties”) with whom we match your request, including our affiliate ProfitBoost Solutions Inc. d/b/a Prime Funding and unaffiliated third-party lenders, so they can evaluate and provide financing.
• Service providers — to vendors and processors that perform services on our behalf (such as hosting, analytics, identity verification, and communications) under contracts limiting their use of the information.
• Affiliates — to companies under common control with us, in connection with evaluating and providing the financing you request.
• Legal and safety — to comply with law or legal process, respond to lawful requests by public authorities, enforce our agreements, and protect the rights, property, and safety of EZ Capital, our users, and others.
• Business transfers — in connection with a merger, financing, acquisition, or asset sale, subject to this Privacy Policy or a successor notice.
• With your direction or consent.
We do not sell your personal information for monetary consideration. Certain disclosures to advertising or analytics providers may be treated as a “sale,” “sharing,” or “targeted advertising” under state privacy laws; to the extent they are, you may opt out as described in Section 8.
5. Financial Privacy Notice (Gramm-Leach-Bliley Act)
This section applies to nonpublic personal information about individuals who obtain or apply for financial products or services that are subject to the Gramm-Leach-Bliley Act (GLBA). Much of the information we handle in connection with commercial financing relates to businesses and is not subject to the GLBA; this section governs the individual nonpublic personal information that is.
(a) Information We Collect. We collect nonpublic personal information from your applications and forms, your transactions with us and others, and consumer reporting agencies — for example, identification information, income and financial information, account and payment history, and credit-report information.
(b) How We Share. We share nonpublic personal information only as permitted by law: to process, service, and complete the transactions you request; with service providers that perform services on our behalf; with funding sources and their service providers to facilitate your financing request; with our affiliates; and as required to respond to legal process or regulators, prevent fraud, or protect our rights.
(c) We Do Not Sell Your NPI. We do not sell your nonpublic personal information, and we do not share it with nonaffiliated third parties for their own marketing except as permitted by law.
(d) Confidentiality and Security. We restrict access to nonpublic personal information to those who need it to provide products or services to you, and we maintain physical, electronic, and procedural safeguards designed to protect it.
(e) Former Customers. We continue to apply this notice to your nonpublic personal information after your relationship with us ends.
6. Cookies and Tracking Technologies
We and our service providers use cookies, web beacons, pixels, and similar technologies to operate and secure our websites, remember preferences, measure and analyze usage, and (where permitted) deliver and measure advertising. Some cookies are necessary for the site to function; others are optional. You can set your browser to refuse some or all cookies, though parts of the Services may then not function. Where required by law, we obtain consent before placing non-essential cookies.
We treat the Global Privacy Control (GPC) browser signal as a valid request to opt out of the “sale” or “sharing” of personal information for the browser or device from which it is sent. We do not currently respond to other “Do Not Track” signals because no common standard exists.
7. Marketing Communications and Your Choices
You may opt out of marketing emails using the unsubscribe link in any such email, and may opt out of marketing calls and texts as described in our Terms and Conditions. Transactional and servicing communications are not promotional and may continue. Your communications consent and revocation rights are described in our Terms and Conditions.
8. Your U.S. State Privacy Rights
Depending on your state of residence and subject to exceptions, you may have some or all of the rights described below with respect to personal information that is not otherwise exempt. Several categories of information we handle — including information governed by the Gramm-Leach-Bliley Act (GLBA) and the Fair Credit Reporting Act (FCRA) — are exempt from these state laws, and the rights below do not apply to exempt information.
(a) Rights. Subject to applicable law and verification, you may have the right to: (i) confirm whether we process your personal information and access it; (ii) obtain a portable copy of certain personal information; (iii) correct inaccurate personal information; (iv) delete personal information; (v) opt out of the “sale” of personal information, “targeted advertising,” or “sharing” for cross-context behavioral advertising; (vi) opt out of certain profiling that produces legal or similarly significant effects; and (vii) not face unlawful discrimination for exercising your rights.
(b) California (CCPA/CPRA). California residents have the rights to know, access, delete, and correct personal information, to opt out of the sale or sharing of personal information, and to limit the use of sensitive personal information. We do not sell personal information for money, and we do not use or disclose sensitive personal information for purposes that require an opt-out under the CPRA. We will not discriminate against you for exercising your rights.
(c) Virginia, Colorado, Connecticut, Utah, Texas, and Other States. Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, and Texas, and additional states as their laws take effect) may exercise the applicable rights above, including the right to opt out of targeted advertising, sale, and certain profiling.
(d) How to Exercise. You or your authorized agent may submit a request by emailing info@ezcapital.com or writing to us at the address below. We verify requests using information associated with your account or that you provide, and may decline requests we cannot verify.
(e) Opt Out of Sale/Sharing/Targeted Advertising. Email info@ezcapital.com with the subject line “Privacy Opt-Out,” or send the Global Privacy Control signal from your browser.
(f) Appeals. If we decline to act on your request, you may appeal by replying to our response or contacting info@ezcapital.com. We will respond within the time your state’s law requires; if your appeal is denied, you may contact your state attorney general.
(g) Response Timing. We respond to verifiable requests within the time required by applicable law (generally 45 days, extendable where permitted). We do not charge a fee unless a request is excessive, repetitive, or manifestly unfounded.
9. Data Retention
We retain personal information for as long as necessary to provide the Services, maintain business records, resolve disputes, and comply with our legal, tax, accounting, and regulatory obligations. Retention periods vary by the type of information and applicable legal requirements. When information is no longer needed, we delete, de-identify, or anonymize it.
10. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and destruction, and we require service providers with access to it to maintain comparable safeguards. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
11. Information Processed in the United States
We are based in and process information in the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States, where data-protection laws may differ from those of your jurisdiction. By using the Services, you consent to this transfer and processing.
12. Children’s Privacy
Our Services are intended for businesses and individuals at least eighteen (18) years old and are not directed to children. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.
13. Third-Party Links and Services
The Services may link to or integrate third-party websites and services we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their practices. Please review their privacy notices.
14. Changes to This Notice
We may update this notice from time to time. When we do, we will post the updated notice with a new effective date and, where required by law, provide additional notice. Your continued use of the Services after the effective date constitutes acceptance of the updated notice.
